Apple and Palm have recently exchanged terse barbs over intellectual property rights, as the veiled threat of litigation looms alongside the upcoming launch of Palm's new smartphone, the Pre. Apple's acting CEO Tim Cook has made it clear that Apple will defend its intellectual property that it feels it has secured with the iPhone 3G. Palm, in turn, has said it will defend itself against any such litigation. One of the main points of contention is multi-touch touchscreen technology--the famous pinching and zooming of the iPhone that the Pre also offers. But how similar are the two devices? FierceWireless takes a side-by-side look to determine the similarities and differences.

However, this review doesn't cover Apple being awarded a patent covering its "multitouch technology" including gestures such as "pinching" and "swiping". How will that play an impact on the Pre? Will they have to pay royalties? Will they have to redesign?

My bet is the patent is rescinded as it seems clear this technology was already in use before Apple tried to patent it... This should allow Palm to go on their merry way...

Apple are just jealous that Palm of triple jumped them. All phones use the basic same UI these days - even coverflow in Windows Mobile. Personally I am underwhelemd by my iphone and will be switching to webOS at the earliest opportunity that European 3G arrives. I hope they bring out a WebOS netbook too, but with some onboard storage.

personally I think that patents are stupid, because it should be whoever can make it best.

Most of the Apple patent is not really enforceable, so what is the point ?. I don't see why the patent office awarded this patent in the first place. There is "prior art" written all over and a Test Case of "Apple Vs Microsoft in 1984" that Apple lost against MS in the "look and feel" of Windows UI.

Unless the Pre actually copies feature sets in implementation in exact verbatim form. These developers knows and works with V1.0 software and they can do V 2.0 without a single common code except "if then" clauses.

Apple can scream all they like. It is all noise. Ed Colligan and his team are no spring chickens!.

All the talk about litigation is just blah, blah, blah as usual from Apple on virtually anything similar to an iPhone feel.
The real proof in the putting is whether Palm can actually launch a new product for the mobile environment that does not require software/hardware updates every 2-3 months until it finally hits it on the nose and then becomes an antiquated model.

I cant believe people are comparing a device that isnt even out yet to one thats been out for over a year. If the iphone is just getting matched now...imagine how good apples next device will be

The iPhone is better than the pre, especially since the palm pre keyboard looks very uncomfortable. Specs wise, the iphone 3G wins:

The Pre is being over-marketed. That wonderful all-in-one SMS/instant messenger hoopla is just that. I have a crappy HTC and I get ALL of my SMS and IMs in one interface. Yahoo, Windows Messenger and AIM in my SMS section of my phone...for free.

As far as that camera...who cares if it has a flash if it's only THREE megapixels. If Palm, Apple or Crackberry want to impress me (or any other serious smartphone user) give me productivity, speed, loads if INTERNAL memory and a 5MP camera WITH a flash in a phone that's thick as a brick of cheese.

Just talking Iphone is superior or Pre is superior is absurd. There are many pro's to Pre at this point like the cheap data plan, tv and multi tasking. When the iphone addresses these then we will talk about it. Pre is not even launched yet. Talking something about patents on these is nothing more than just stupid. Things get better only when we have a similar likewise product or service. Palm can easily get over this crap suit.
