Court halts Sprint-iPCS suit over WiMAX

Sprint affiliate iPCS claimed a legal victory after the Delaware Chancery Court stayed a lawsuit there pending the outcome of litigation between iPCS and Sprint in Illinois.

Schaumburg, Ill.-based iPCS and Sprint have been involved in litigation for months over Sprint's decision to merge its WiMAX business with Clearwire Corp. iPCS contends the move will violate exclusivity agreements it has with Sprint in certain areas in the Midwest, including in Illinois.

In mid-September, a Cook County, Ill. judge refused to dismiss the lawsuit brought by iPCS against Sprint there. In July, the Delaware court had allowed Sprint to go ahead and determine whether or not the deal would violate an exclusivity agreements. That now appears to have been put on hold.

Sprint is hoping the Clearwire deal, which has financial backing from large players such as Comcast, Intel and Google, will be finalized by the end of the year.
