Phone rebate lawsuit vs. Cingular greenlit
A federal court has ruled that a lawsuit brought against the former Cingular Wireless for alleged misleading advertising on phone "rebates" can proceed.   The suit states that the cell phone company promised to pay rebates to people who bought mobile phones, and advertised discounted prices that reflected the promised rebate. However, instead of a rebate check, phone buyers received a "VISA Reward card" that came with certain restrictions, including a time constraint. Of course, once the Visa card arrived by mail, the subscribers were already signed up and had to pay the typical $175 early termination fee to cancel their service.ÂÂ
The court stated: "The court finds that a reasonable consumer, upon seeing an advertisement that promises a 'rebate' of a certain amount, would generally understand that advertisement to mean that the amount will be returned to the consumer in cash, check or its equivalent... The more terms, conditions and restrictions that are placed upon the form of tender, the less equivalent it becomes to cash or check..."

This "deal" was the classic bate and switch. I bought three phones for my family and I put the gift cards in a drawer without reading the fine print, only to try use them six months later after they were expired. This is not exactly the deal that I thought that I signed up for participation in. The court case should go forward so that people can get what they bargained for. Also, I am sick an tired of being sent forms printed incomprehensible fine print that alter the basic terms of the agreement that I thought I had with the company previously. Buyer beware always and forever!
Verizon has a new bait and switch. Their latest on-going commericals for FIOS offer a free TV is a TV you will never get. After filling all the fields for TV, phone and internet service and selecting the "Check Out" button. You will be presented with a form to switch your phone service (basic and long distance) to Verizon. Well, that's to be expected since you are going to have Verizon as you provider. But, what you don't know is that after you authorize the switch --- they then tell you that you cannot get the "free" hd tv! Why? Because the installation must before a particular date and the only date they will make available is AFTER the deadline for recieving the tv!!! Classic bait and switch. Get you in the store, get your money in their hand (ie, the cost of switching phone service) and then say "Oh, sorry" we don't have that item. Tough luck. We warned you that it was on a first come first serve basis. You had to have it install befor date X and the only dates we have available is +X." This is fraud exactly because they know are can reasonably be expected to know that they don't have anyone to install the system ber for date +X at the time they are taking your order (the moment of advertisting online!). The knowledge of this in undisputable since no sooner that you switch phone services, they tell you that you cannot get a date by the deadline (date X). This is a slimy business practice.
Lots of people aren't going to find out they are not getting their free tv until many weeks have passed and they have already switched phone service. When they attempt to switch back they might incur another fee and then of course the is the Verizon fee for stoping the Verzon FIOS service. And, should they choose to keep the phone service but drop FIOS or even keeping FIOS (without the free TV), they will likely be not eligible for future deals, since such deals will be for NEW customes!
Be aware, you will also pay for the electrity to run your FIOS. And, you will pay for a replacement backup battery for you FIOS phone! If that's anything like laptop batteries, that could cost you $100 per year! And, guess who will sell it to you!
And, waht about that fast internet connection. They don't promise it. Yes, system go down, but they aren't talking just about that, they don't promise the 15 mps speed at all!
