Sprint developing an ITC workaround?

During the course of the week there have been various reports that Sprint Nextel is developing a workaround for the ITC ban on Qualcomm chipsets in 3G handsets. Speculation about a Sprint Nextel workaround began when Sprint Nextel product manager, Brita Horton, told a reporter that the carrier had a solution that would free Sprint from the ITC ban. An official Sprint Nextel spokesperson, Matt Sullivan, has since said that Horton had "spoken out of turn," and did not have the authority to comment on the issue. Sullivan also said that "there's no software patch free of technical, procedural and legal uncertainties."
