AT&T asks judge to force Sprint to hand over documents related to proposed T-Mobile deal

AT&T (NYSE:T) has asked a federal judge to force Sprint Nextel (NYSE:S) to hand over documents AT&T subpoenaed for its defense against the Department of Justice's lawsuit aiming to block AT&T's purchase of T-Mobile USA.

AT&T said Sprint has yet to respond to its Sept. 26 demand.

"Sprint has not produced a single document," AT&T said in the filing. "Instead Sprint contends it is not required to comply with the subpoena," arguing it already turned documents over to the Justice Department during its review of the $39 billion merger announced March 20, AT&T said.

The documents in question pertain to transactions Sprint has entered into since January 2004, including deals with Nextel, Virgin Mobile, and Clearwire (NASDAQ:CLWR). AT&T said Sprint hasn't proven that the documents it turned over to the DOJ would satisfy AT&T's request.

In a filing Sprint made on Oct. 19th, the operator said that AT&T's document requests "go far beyond ordinary, non-party merger case discovery, which focuses on the current competitive landscape, not on the details of every transaction entered into by a competitor in the last eight years."

Sprint has filed its own antitrust lawsuit against AT&T's proposal to purchase T-Mobile, arguing the deal would hurt competition.
