After three delayed votes from the FCC on whether to approve the AT&T-Bellsouth merger, industry pundits have said that Republican Commissioner Robert McDowell may have to vote. McDowell recused himself from the case since he lobbied for Bell competitors for six years prior to his appointment. McDowell said the marketplace should decide over government regulation, but sometimes the government must step in to address market failures, those actions must be "narrowly tailored and sunsetted."
